WARNING - Understanding California’s Proposition 65 What started out in 1986 as a reasonable effort to protect drinking water from chemical contamination, has exploded in scope to include over 1,000 chemicals and ingredients found in just about everything. The Los Angeles Times wrote recently, “Warnings (about Prop 65) are everywhere: parking lots hardware stores, hospitals and just about any decent-sized business.” Disneyland even posted signs that say something to the effect of, Warning, the Disneyland Resort may cause cancer. Prop 65 requires warning labels be placed on products that may contain any trace of the 1,000 plus chemicals or ingredients that California determined to be a carcinogen or a reproductive toxicant. To eliminate the general or universal warnings like the Disneyland example above, California now requires that the specific chemicals and/or ingredients be identified. The culprit in our products is Wood Dust. The law requires this exact wording be used on the warning labels: “This product may expose you to chemicals including Wood Dust, which is known to the state of California to cause cancer or birth defects or other reproductive harm. For more information go to www.p65Warnings.ca.gov/furniture.” If it were possible, we would only place these warning labels on the products being sold in California. Unfortunately, we build product to stock so we can ship it faster. It’s not possible to pre-determine which pieces will ship into California. Therefore, we must place these warning labels on everything we build to protect ourselves form litigation and huge fines from the state of California. Please rest assured that our commitment to consumer safety will never waiver. Certainly, there are differences of opinions regarding California’s Prop 65 but Legends Furniture will continue to honor and adhere to all safety and compliance regulations.
